Your Data Rights
Many U.S. states provide their residents certain data privacy rights, such as the right to opt out of receiving marketing emails or having their personal information shared with third parties for targeted advertising purposes. Depending on your state of residence, you may have additional rights, as well, including the right to request the deletion of your personal information. This section details how you can exercise those rights. Please note that we may maintain copies of information that you have updated, modified, or deleted in our business records and in the normal course of our business operations where permitted or required by law.
For California Residents: Notice at Collection and Your California Privacy Rights
Under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 and its enabling regulations (“CCPA”), California residents have certain rights with respect to our collection and processing of their personal information.
As described in further detail above, in the past 12 months we have collected Network Activity and certain Personal Identifiers. We use this information for the following purposes:
- To communicate with our clients;
- To provide services to our clients;
- To present the Site to you in a consistent way that reflects your privacy preferences;
- To perform analytics about consumer engagement and the effectiveness of the Site and to resolve technical issues with the Site;
- To comply with our legal obligations and all applicable laws; and
- To confirm the authenticity of log-in requests and to police the security of our Site.
In the past twelve months, we have disclosed personal information—including professional and biographical information we have compiled about our target customers (such as name, job title, and employer)—with third parties for targeted advertising as described in the section entitled Interest-Based Advertising above. We have not collected sensitive personal information of any kind. We retain your personal information for as long as necessary to fulfil the business purposes for which it was collected, or for as long as otherwise required by applicable law.
Your California Privacy Rights
California residents have a number of privacy rights under the CCPA, including:
- The right to know what personal information we have collected about you and the right to access that information;
- The right to correct inaccurate information;
- The right to request the deletion of your personal information (subject to certain exceptions);
- Opt-Out. The right to opt out of the “sale” of your personal information to third parties (under the CCPA, a “sale” includes our sharing your personal information with third parties even if we are not paid any money in return);
- Data Portability. The right to obtain your information in a structured and commonly used machine-readable format, to the extent technically feasible; and
- Equal treatment. The right not to be discriminated against for exercising any of your privacy rights.
We will not discriminate against you for exercising any of your privacy rights. We will not deny you goods or services, charge different prices or rates, or provide a different level of service if you exercise any of these rights. However, because some of our programs or services require your personal information to function properly, our compliance with your request may limit your ability to use these programs or services.
To exercise these rights, please see the section of our Privacy Policy entitled “Exercising Your Data Rights” below.
Under California’s Shine the Light law, California residents have the right to request that we provide you with (i) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year; and (ii) the identity of those third parties. In the immediately preceding calendar year, we have not shared your personal information with any third party for that third party’s own direct marketing purposes, and our agreements with our third parties prohibit them from using your personal data for any such purpose.
California law requires that any business that offers a financial incentive for the collection of your personal data—such as a rewards program, premium features, discounts, loyalty points, or club card programs—must provide you with notice of the material terms of the program, obtain your opt-in consent to participate in the program, and offer you the ability to revoke your participation or consent at any time. We do not offer any such financial incentives or programs.
Additional Privacy Information for Residents of Certain States
Residents of certain U.S. states (including Virginia, Colorado, and Connecticut) may have additional rights, subject to certain limitations and exceptions, under the privacy laws of their respective states. These rights may include:
- The right to know what personal information we have collected about you and the right to access that information;
- The right to correct inaccurate information;
- The right to request the deletion of your personal information (subject to certain exceptions);
- Opt-Out. The right to opt out of the sale of your personal information to third parties; and
- Data Portability. The right to obtain your information in a structured and commonly used machine-readable format, to the extent technically feasible.
For EU Residents
If you are located in the European Union or other regions with laws governing data collection and use that may differ from United States law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. When we transfer personal information to third-party controllers, we will protect your information as described in this Privacy Policy or as disclosed to you at the time of data collection and in accordance with applicable law.
When we process your personal information as described in this Privacy Policy, we will only do so where we have lawful bases for the specific purpose or activity involved, which may include the following:
- We may use your personal information where we have a legitimate interest in doing so, including to communicate with you and to send you information by email, postal mail, telephone or other means about our product and services and to improve and secure those products and services.
- We may process your personal information where we receive your consent to do so. Where we rely on your consent for processing your personal information, you may withdraw that consent at any time.
If you are located in the European Union, subject to applicable exemptions and limitations, you have the right to access personal information we hold about you and to ask that such personal information be erased, corrected, or transferred. You may also have the right to object to our processing of your personal information or to request that we restrict certain processing.
To exercise these rights, please see the section of our Privacy Policy entitled “Exercising Your Data Rights” below.
For Residents of Other Jurisdictions
If you are located in a region other than the United States or the European Union, you may have data rights, subject to certain exemptions, granted to you by your respective country or jurisdiction, which may include the right to know, access, correct, delete, or other similar rights related to your personal information.
Exercising Your Data Rights
To exercise any of your rights as set forth above, please contact us at helpdesk@logicsource.com, or by mail or telephone number as provided in the “Contact Us” section.
You may opt out of marketing emails or manage your subscription preferences for emails from us at any time by clicking on the “Unsubscribe” link in any marketing email we send you. We will process your opt-out request within ten business days of receiving it. Even if you opt out of marketing emails, we may still send you non-commercial emails including responses to direct requests.
You may opt out of our sharing your personal information with third parties by clicking on the “Do Not Sell or Share My Personal Information” https://logicsourcedev.wpengine.com/do-not-sell-my-personal-information/ link or by clicking the “Cookie Preferences” https://logicsourcedev.wpengine.com/link and adjusting your preferences for most cookies (other than those that are necessary for the proper functioning of the Site).
Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to process your request to opt out from certain types of data processing, including data “sales” as defined under certain laws. If we detect that your browser is communicating a GPC signal, we will process that as a request to opt that particular browser and device out of sales and sharing though the Site. Please note that if you return to the Site from another browser or device, you may need to opt out (or set GPC for) that browser and device as well. More information about GPC is available at https://globalprivacycontrols.org.
If you are located in the European Union, you can also have recourse to the European Data Protection Supervisor or with your nation’s data protection authority.
